Terms of Service for Everherd

Effective date: 16 October 2026
Last updated: 16 October 2026

1. Who these terms are with

Everherd ("the Game") is provided by Scoville Games Ltd, a company registered in England and Wales (company number 17413330), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom ("we", "us", "our").

By downloading or playing Everherd you agree to these terms. If you do not agree, please do not use the Game.

Our Privacy Policy explains what we do with data and forms part of these terms.

2. Children and parents

Everherd is designed for players of all ages, including children.

If you are under 18, please read these terms with a parent or guardian. If you are a parent or guardian and you let a child use your device, you are responsible for that use, including any purchases made on it. We strongly recommend turning on your device's purchase controls: Ask to Buy on iOS, or purchase authentication in the Google Play Store.

3. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play Everherd on devices you own or control, for your own private and non-commercial enjoyment.

You may not:

We own the Game and everything in it: code, artwork, animals, music, sounds, names and logos. The licences to third-party assets used in the Game remain with their owners.

4. Playing for free

Everherd can be played from beginning to end without spending anything. Every animal, farm and level of progress can be reached without paying. Some optional extras, such as cosmetic looks, boost bundles and the ad-free unlock, are available only by purchase.

5. Purchases

Some optional extras can be bought with real money. If you buy one:

Refunds. Because the store handles payment, refunds are handled under Apple's and Google's refund policies, and you should apply to them. If you are a consumer in the UK or EU you have a statutory right to cancel a digital purchase within 14 days, unless you agreed to immediate delivery and acknowledged losing that right, which is what confirming a purchase in the store normally does. Nothing in these terms affects your statutory rights. If you think something has gone wrong with a purchase, write to us at support@scovillegames.com and we will help where we can.

6. Advertising

The Game offers optional rewarded videos. Watching one is always your choice, declining costs you nothing, and no reward is ever taken away for declining. Players at or above the age of digital consent may occasionally also see a full-screen advert at a natural break in play. How advertising uses data, and the choices you have, are described in the Privacy Policy. A one-time purchase is available that grants the video rewards without any video and removes adverts.

7. Your saved progress

Your progress is stored on your device, and a backup copy is kept against an anonymous ID as described in the Privacy Policy.

Please understand that progress can be lost: if you delete the Game, lose or reset your device, or if a technical fault occurs. We will try to help if you contact us with your Support ID, but we cannot guarantee that progress can be recovered, and we are not liable for lost progress or lost in-game items except where the law makes us so.

8. Changes to the Game

Games change. We may add, alter, rebalance or remove features, content and prices, and we may issue updates. We may also stop supporting older devices or operating system versions.

If we ever have to shut the Game down permanently, we will give reasonable notice inside the Game where we can.

9. Suspension

We may suspend or end your access if you seriously or repeatedly break these terms, in particular by cheating or manipulating purchases. Given the Game is single-player and offline capable, this is a remedy we expect never to use.

10. Disclaimers and liability

The Game is provided "as is". We do not promise it will always be available, uninterrupted or free of errors.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for damage to your device or other digital content caused by a fault in the Game, or for your legal rights if the Game or something you bought in it is faulty or not as described (including a repair, replacement or refund).

The Game is for private, non-commercial use only. Subject to the paragraph above, and to the extent the law allows, we are not liable for any loss of profit, business, revenue or business opportunity, or for any loss that was not reasonably foreseeable when you started playing. Our total liability to you in connection with the Game is limited to the greater of the amount you paid for purchases in the Game in the twelve months before the claim, or 50 GBP.

If you are a consumer, you have legal rights that these terms cannot take away, and you keep them.

11. No rights for anyone else

These terms are between you and us. No one else has any right to enforce them, including under the Contracts (Rights of Third Parties) Act 1999.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you keep the protection of the mandatory laws of your own country and may bring proceedings there.

13. Changes to these terms

We may update these terms. We will change the date at the top, and where a change matters we will tell you in the Game the next time you play. Continuing to play after a change means you accept it.
